Terms of Use
The house rules for daycare, boarding, grooming, PupCam, and our store, written so a person (not just a lawyer) can read them.
1. Acceptance of Terms
By accessing or using the Trail Mutts website (trailmutts.com), booking a service, purchasing a product, or otherwise using Trail Mutts’ day ranch, wellness, or e‑commerce offerings (together, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you don’t agree, please don’t use the Services. We may update these Terms from time to time, as described in Section 19.
2. About Trail Mutts
Trail Mutts is a doggie day ranch and wellness outfit based in Lubbock, Texas. We offer daycare, boarding, grooming, supervised playtime, and PupCam live‑video membership, plus an online store selling treats, food, grooming products, merchandise, and gift cards. We also partner with Operation Pawprints, a 501(c)(3) nonprofit — see Section 14.
3. Eligibility
You must be at least 18 years old to create an account, book a service, make a purchase, or enter payment information on trailmutts.com. The site and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us at [email protected] and we will delete it.
4. Accounts & security
Some features require an account, which you access via a passwordless “magic link” sent to your email. You’re responsible for keeping your email account secure and for all activity that occurs under your Trail Mutts account. Notify us immediately if you suspect unauthorized use.
5. Services & bookings
Daycare, boarding, grooming, playtime, and PupCam sessions are booked through the site and require prepayment at the time of booking.
Cancellation, refund & no‑show policy (default):
- Cancel at least 24 hours before your scheduled start time: full refund to your original payment method.
- Cancel less than 24 hours before your scheduled start time: refund at Trail Mutts’ discretion.
- No‑shows (not arriving without cancelling): non‑refundable.
6. Dog‑owner requirements
To keep every dog on the ranch safe and healthy, we ask owners to meet the following before their dog’s first visit and throughout their time with us:
- Current vaccinations on file, including rabies, DHPP (distemper, hepatitis, parainfluenza, parvovirus), and Bordetella (kennel cough), plus any additional vaccination or preventive care we may require from time to time.
- Your dog is in good health and free of fleas, ticks, and other parasites, and is up to date on prevention.
- You’re responsible for your dog’s temperament and behavior. Trail Mutts staff exercise judgment in good faith, and Trail Mutts may refuse admission to, or remove from a program, any dog whose behavior, illness, or condition puts other dogs, guests, or staff at risk — without refund for the remaining scheduled time.
By booking, you authorize Trail Mutts to seek emergency veterinary care for your dog if we’re unable to reach you promptly, at your expense, and you agree to reimburse Trail Mutts for reasonable costs advanced on your behalf.
7. PupCam / live video acceptable use
PupCam is a members‑only benefit that lets you view live camera feeds of daycare/boarding areas and join scheduled video calls with staff. Access is for the personal, non‑commercial use of the account holder and their household. You may not record, screenshot, download, redistribute, publicly display, or otherwise share PupCam footage or calls — including footage of other members’ dogs or shared areas — except for your own personal record‑keeping about your own dog. We may suspend PupCam access for misuse.
8. Store purchases
Prices and availability of store items (treats, food, grooming products, merchandise, and gift cards) are subject to change without notice. We make reasonable efforts to keep listings accurate but don’t guarantee that descriptions, pricing, or availability are error‑free. Gift cards are non‑refundable, non‑reloadable, and not redeemable for cash except where required by law.
Returns (default):
Unopened, unused physical products in resalable condition may be returned within 14 days of delivery for a refund to the original payment method. Opened food/treats, perishable, and personalized items are final sale unless defective.
9. Payments
All payments are processed by Stripe, our third‑party payment processor. Trail Mutts does not store your full card number, CVV, or other sensitive card data on our servers — that information goes directly to Stripe, under Stripe’s own terms and privacy policy. You authorize us to charge your chosen payment method for bookings, purchases, and any applicable taxes or fees at checkout.
10. Subscriptions & auto‑renewal
Some Trail Mutts offerings are recurring subscriptions that automatically renew and re‑bill until you cancel: PupCam memberships, home‑visit subscription plans, and the Trail Mix treat‑box subscription. When you sign up for any of these:
- Automatic renewal. Your subscription renews automatically at the end of each billing period (for example, monthly) and your payment method is charged the then‑current price for that period, until you cancel. The billing frequency and amount are shown to you before you subscribe and on your account page.
- Cancel any time, free. You can cancel from your account (or by contacting us) at any time, with no cancellation fee — cancelling is at least as easy as signing up. Cancellation stops all future charges and, for the treat box, future shipments. It does not refund a charge already made, or a box already shipped, for the current period.
- Price changes. We may change subscription prices. We’ll give you advance notice before a change takes effect, and you may cancel if you don’t agree; continuing after the change takes effect means you accept the new price.
- Failed payments. If a renewal charge fails, we may retry it and notify you; if it keeps failing, we may pause or cancel the subscription.
Trail Mix treat‑box — shipping & pausing:
- Shipping is included in your monthly price — a flat shipping charge shown when you subscribe, not a separate add‑on. Keep your shipping address current.
- Pause. You can pause your treat‑box subscription from your account. While paused, you are not charged and no box ships, until you resume. Resuming restarts billing and shipments on the next cycle.
- Pause fee (fair use). Your first pause in any 90‑day period is free. A second or later pause within the same 90‑day period adds a $5 processing/handling fee to that pause. This fee applies only to repeated pausing — you can always cancel outright for free. The fee and this limit are shown to you before you subscribe and before any pause that would incur it.
- Consumable products. Treats are perishable/consumable; opened or delivered boxes are final sale and non‑refundable except where required by law or if defective (see Section 8).
By subscribing, you affirmatively authorize these recurring charges (and, for the treat box, the pause fee above when it applies).
11. Communications & text messaging consent
When you create an account, request an estimate, or otherwise give us your contact details, you agree that we may contact you about your request and your account. If you separately opt in (for example, by checking the consent box on our estimate form), you also agree that Trail Mutts may contact you by phone, automated or live, and by text message (SMS) — including with marketing messages such as ranch news, tips, and offers.
- Consent to receive marketing calls or texts is not a condition of booking or purchasing anything.
- Message and data rates may apply, and message frequency varies.
- You can opt out of marketing texts at any time by replying STOP (or HELP for help), and opt out of marketing email using the unsubscribe link in any message.
- We keep a record of your consent — the exact language shown and the date and time you agreed — as described in our Privacy Policy.
- Transactional messages that respond to a request you submitted are not marketing and may continue as needed to provide the Services.
12. User conduct / prohibited uses
When using the Services, you agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Interfere with or attempt to compromise the security or integrity of the site.
- Scrape, harvest, or collect data from the Services without our permission.
- Impersonate another person or misrepresent your affiliation with anyone.
- Upload viruses, malware, or other harmful code.
- Misuse PupCam access (see Section 7).
- Behave abusively or threateningly toward staff, other guests, or their dogs.
- Provide false information about your dog’s vaccination or health status.
13. Intellectual property
The Trail Mutts name, logo, “Day Ranch” branding, site design, photography, and written content are owned by Trail Mutts or its licensors and protected by copyright, trademark, and other laws. You may not copy, reproduce, or use our brand assets without our prior written permission, except as needed to use the Services as intended (for example, sharing a link to a page).
14. Third‑party links
The Services may link to third‑party sites, including our partner Operation Pawprints (a separate 501(c)(3) nonprofit) and other organizations. We don’t control, and aren’t responsible for, any third‑party content, policies, or practices. Donations made through a third‑party link go directly to that organization, not to Trail Mutts.
15. Disclaimers & assumption of risk
Dog daycare, boarding, grooming, and group play carry inherent risks — dogs are animals, and even well‑socialized, healthy dogs can act unpredictably around other dogs, people, or new environments. Risks may include, without limitation, minor scrapes or scuffles, illness transmitted between dogs, and stress‑related behavior. By booking, you acknowledge and accept these inherent risks.
The services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non‑infringement, to the fullest extent permitted by law.
16. Limitation of liability
To the fullest extent permitted by law, Trail Mutts and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Our total liability for any claim arising out of these Terms or the Services will not exceed the amount you paid to Trail Mutts for the service giving rise to the claim in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under Texas law.
17. Indemnification
You agree to indemnify and hold harmless Trail Mutts and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your dog’s behavior, your breach of these Terms, or your violation of any law or third‑party right.
18. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict‑of‑laws rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Lubbock County, Texas, and you consent to personal jurisdiction there.
19. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll update the effective date above and, where appropriate, provide additional notice (such as a site banner or email). Continued use of the Services after changes take effect means you accept the updated Terms.
